So besides trying to mandate condoms in porn, it looks like Cal/OSHA is looking into the case of “Patient Zeta” now. And having just as much trouble as everyone else who's tried.
Despite Patient Zeta having come out to the entire world, Alameda Superior Court Judge Winifred Y. Smith denied Cal/OSHA access to any part of his medical records, including his employer's name.
Cal/OSHA spokesperson Patricia Ortiz said they didn't even ask for Patient Zeta's name. They just wanted to know who he works for. She says Cal/OSHA's investigation has turned to how Patient Zeta's employer handled the infection.
However, Judge Smith believes Cal/OSHA failed to prove they can't complete their investigation without just investigating the porn companies.
“Cal/OSHA has not demonstrated, by evidence or argument, a compelling need for the information sought in the subpoena,” Judge Smith said in her decision. “Nor has it demonstrated that its subpoena is narrowly tailored to minimize the intrusion on plaintiff’s privacy issues.”
